1. Introduction

Welcome to New England PoGo Map, a subscription service providing access to a map with live data (the "Service"). By subscribing to and using our Service, you agree to these Terms of Service ("Terms"). Please read them carefully. If you do not agree to these Terms, you may not use the Service.

2. Subscription Plans

We offer three subscription tiers:

• Collector: A monthly subscription that automatically renews every month.
• Ace Trainer: A monthly subscription with additional benefits that automatically renews every month.
• Vacationer: A weekly subscription that does not automatically renew.

By subscribing to any of these tiers, you agree to the terms specific to each, as outlined below.

3. Account Registration

To use the Service, you must register for an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer or device. You agree to accept responsibility for all activities that occur under your account.

4. Subscription and Payment

4.1. Subscription Fees

• Collector: $5 per month.
• Ace Trainer: $10 per month.
• Vacationer: $5 per week.

All prices are in USD. By subscribing, you authorize us to charge your payment method automatically on a recurring basis, depending on your subscription tier.

4.2. Automatic Renewal

Collector and Ace Trainer subscriptions automatically renew each month on the same day you originally subscribed. Your payment method will be charged on each renewal date unless you cancel your subscription before the renewal date. Vacationer subscriptions are for a one-week term and do not automatically renew. You must manually subscribe again if you wish to continue using the Service.

4.3. Cancellation

You may cancel your Collector or Ace Trainer subscription at any time through your account settings. Your subscription will remain active until the end of the current billing period, and you will not be charged for the following period. Please note that previously paid subscription fees are non-refundable. No refunds or credits will be provided for any unused portion of a subscription, even if you cancel before the end of the current billing period.

5. Service Availability

We strive to keep the Service available 24/7, but we do not guarantee uninterrupted access. We reserve the right to modify or discontinue the Service, temporarily or permanently, with or without notice. We are not liable for any interruptions or downtime.

6. Use of Service

You agree to use the Service only for lawful purposes and in a manner consistent with these Terms. You may not: Share your account with others. Use the Service in a way that could damage, disable, overburden, or impair the Service. Attempt to gain unauthorized access to the Service or its related systems or networks.

7. Limitation of Liability

To the maximum extent permitted by law, NEMAP shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from your use of the Service, including but not limited to loss of data, even if NEMAP has been advised of the possibility of such damages.

8. Indemnification

You agree to indemnify and hold harmless NEMAP, its affiliates, and its employees from any claims, damages, liabilities, costs, or expenses (including reasonable attorneys' fees) arising out of your use of the Service, your violation of these Terms, or your violation of any rights of another.

9. Changes to Terms

We may update these Terms from time to time. If we make significant changes, we will notify you through the Service or by other means, giving you the opportunity to review the changes before they become effective. Your continued use of the Service after the changes become effective constitutes your acceptance of the new Terms.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law principles.
